Thursday, January 1 0, 2008 – Barbara Brewitt, Ph.D. founder, CEO and Chief Scientific Officer at Seattle based Biomed Comm Inc., has been found innocent of charges that she was ‘practicing medicine without a license’. The Honorable Judge Charles Mertel judicially reviewed the case dropping the charge against Brewitt, calling it ‘ABSURD’.

Brewitt is an innovator, awarded and recognized by leading edge business and natural product industry pundits. She won FAST COMPANY’S FAST 50 award in 2004 as a socially responsible business woman and scientist  who is contributing to make health and people’s lifestyles better and safer.  She also was a finalist in the prestigious Nellie Cashman business woman’s award in 2005 for her integrity and social responsibility.

Dr. Brewitt requested assistance from the State DOH to help Biomed Comm, Inc. move to a new phase of company growth. Instead of helping, the DOH chose to abandon the law, attack Brewitt and issue her a Cease and Desist order claiming she was ‘practicing medicine without a license’. This violation, if true, is both a civil and criminal offense. Brewitt appealed through King County Superior Court’s judicial review and won on January 4, 2008. “The Department of Health appears to have an agenda to deprive Washingtonians of health care choice, especially targeting those who offer complementary and alternative medicines. The DOH is aligned with pharmaceutical drug and health insurance companies which stop diversity and health choice.’  Brewitt said

Dr. Barbara Brewitt is recognized for proving safety and effectiveness of patented homeopathic protein products, called growth factors that she and Biomed Comm, Inc. own and sell globally.  Biomed Comm, Inc. and independently operated clinical studies have shown efficacy and safety of these homeopathic products. Without harm, risk of harm or consumer complaint, the DOH invaded Brewitt’s private affairs to gather evidence and trade secret information. The State purposefully mixed together information and identities of Brewitt and Biomed Comm, Inc. to tell a new defamatory story that damaged Brewitt’s credibility and integrity without factual basis or accuracy.

The judge sealed Biomed Comm’s confidential information stating that he was disturbed that the DOH would have company trade secrets in the public record.  He also pushed the DOH’s mixing of Brewitt and Biomed Comm identities back to the lower court for clarification asking why this had not been more definitively resolved before landing in his courtroom.

Dr. Brewitt states that the State DOH answers to the people, not vice versa.  Natural medicine choice and access by people versus control over health care by conventional medical allegiances in Washington State are at issue. A socially responsible and innovative Ph.D. poses opportunity, not ‘threat’ to the health care needs of Washingtonians facing a health care crisis.
